2. Eligibility and Account Responsibilities

– You must be able to form a binding agreement and comply with these Terms to use Paltrin One.
– You are responsible for the accuracy of information you provide and for keeping your account credentials secure.
– You are responsible for activity that occurs under your account, including activity by users you invite or authorize.
– You must notify Paltrin if you believe your account, connected devices, or integrations have been accessed without authorization.

3. Houses, Admins, and Shared Access

Paltrin One may allow users to create or join houses, invite members, assign administrative access, and share access to dashboards, devices, integrations, alerts, and settings.

– House owners and admins are responsible for managing who has access to a house and its connected information.
– Users with access to a house may be able to view device information, telemetry, alerts, and integration status for that house.
– Admins may be able to add, modify, disconnect, or control supported devices and integrations.
– You should only invite people you trust and should remove access when it is no longer appropriate.

4. Device Data, Alerts, and Monitoring

Paltrin One may display sensor readings, device states, diagnostics, alerts, trends, and other information from supported devices and services. This information may be delayed, incomplete, inaccurate, unavailable, or affected by device failures, connectivity issues, user settings, third-party service outages, or other conditions outside Paltrin’s control.

– Paltrin One is not an emergency response, life safety, medical, fire detection, carbon monoxide detection, security, or professional monitoring service.
– Alerts and automations are provided for convenience and should not be relied on as the only way to detect unsafe, abnormal, or urgent conditions.
– You remain responsible for maintaining your home, HVAC equipment, sensors, alarms, safety devices, and connected systems.
– For urgent, unsafe, or emergency conditions, contact qualified professionals or emergency services as appropriate.

5. Device Control and Automations

Some Paltrin One features may allow you to send commands, adjust settings, trigger automations, or control supported connected devices. You are responsible for reviewing commands, automations, schedules, and settings before enabling or using them.

– Device commands may fail, be delayed, be rejected by a device or third-party service, or produce unexpected results.
– You should not use Paltrin One to control equipment where failure, delay, or error could cause injury, property damage, or other serious harm.
– You are responsible for ensuring that any automations or controls you configure are appropriate for your property and equipment.

6. Third-Party Services and Integrations

Paltrin One may integrate with third-party products, platforms, APIs, and services. These third-party services are provided by their respective owners and are governed by their own terms, privacy policies, permissions, rate limits, availability, and technical requirements.

– When you connect a third-party service, you authorize Paltrin to access and use information from that service as needed to provide the requested integration.
– Paltrin is not responsible for third-party services, devices, outages, changes, data accuracy, API limitations, account restrictions, or discontinued features.
– You are responsible for complying with the terms and account requirements of any third-party service you connect.
– Disconnecting an integration may limit or disable related dashboards, alerts, automations, controls, and historical syncing.

7. Acceptable Use

You agree not to:

– Use Paltrin One for unlawful, harmful, abusive, fraudulent, or
unauthorized purposes
– Attempt to access accounts, houses, devices, data, systems, APIs, or

unreasonable safety, security, or property risk
– Upload, transmit, or store malicious code or content that violates the
rights of others
– Misrepresent your identity, affiliation, device ownership, or
authority to connect a device or service

8. Software, Updates, and Availability

Paltrin may update, modify, suspend, discontinue, or limit any part of the platform at any time. We may release app updates, API changes, firmware-related features, integration changes, bug fixes, or security
improvements. Some features may require a current app version, compatible hardware, internet access, third-party accounts, or supported devices.

We do not guarantee that Paltrin One will be uninterrupted, error-free, compatible with every device, or available in every location.

9. Privacy and Data

Our collection, use, storage, and sharing of information is described in the Paltrin Privacy Policy. By using Paltrin One, you acknowledge that your information will be handled according to that Privacy Policy.

10. Ownership and Feedback

– Paltrin and its licensors own the platform, software, interfaces, designs, trademarks, and related intellectual property.
– You retain ownership of information and content you provide, subject to the rights needed for Paltrin to operate, secure, support, and improve the platform.
– If you submit feedback, suggestions, or ideas, Paltrin may use them without restriction or compensation.

11. Fees and Paid Features

Some features may be offered for a fee now or in the future. If paid features are offered, pricing, billing terms, renewal terms, cancellation options, and any applicable taxes will be presented where you purchase or activate those features. Unless otherwise stated, fees are non-refundable except where required by law.

12. Account Suspension and Termination

You may stop using Paltrin One at any time. Paltrin may suspend or terminate access to the platform if we believe you have violated these Terms, created risk for Paltrin, users, devices, third-party services, or others, or if continued access would be unlawful or harmful.

Upon termination, some features may stop working, integrations may be disconnected, and some information may be retained as described in the Privacy Policy or as required for legal, security, fraud prevention, dispute resolution, or legitimate business purposes.

13. Disclaimers

Paltrin One is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the fullest extent permitted by law, Paltrin’s total liability for any claim arising from or related to the platform or these Terms will not exceed the amount you paid to Paltrin for the service during the twelve
months before the event giving rise to the claim, or one hundred U.S. dollars, whichever is greater.

15. Indemnification

You agree to defend, indemnify, and hold harmless Paltrin and its owners, officers, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of Paltrin One, your connected devices or integrations, your violation of these Terms, your violation of law, or your infringement of another person’s rights.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify users through the app, website, email, or other appropriate means. Continued use of Paltrin One after updated Terms are posted or become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the United States and the applicable laws of the state in which Paltrin L.L.C. is organized, without regard to conflict of law principles. Some jurisdictions provide rights that cannot be waived or limited by contract, and these Terms do not limit those rights where prohibited by law.
